IntroCam™ is a new form of online camera that enables audiovisual statements and testimonials across distances, independently of scheduling or camera crew coordination. The service provided by IntroCam™ consists of supplying the technical infrastructure for the recording of short videos such as the logistical handling for selected testimonials.
IntroCam™ provides the audiovisual communication solution. IntroCam™ is not responsible or liable for the content of recorded testimonial videos. Responsibility for the content of recordings lies solely with the persons recording and with the customer who commissioned the recording.
IntroCam™ is a service of IntroCam™ Authentic Recording, P.O.Box Dubai (hereinafter referred to as the “Service Provider”).
Section 1 — Scope and Subject Matter
(1) IntroCam™ provides users with a browser-based camera tool via www.introcam.com (hereinafter the “Platform”) enabling the independent recording of short videos (testimonials, statements, reviews). The service is directed exclusively at business customers within the meaning of applicable commercial law.
(2) These Terms & Conditions govern the provision of services by the Service Provider and their use by customers. They apply exclusively. Conflicting, supplementary, or deviating terms will not be recognised.
(3) The Service Provider does not become a party to any agreements that may arise between the customer and the persons recording videos (testimonial givers) and he assumes no liability for the content.
Section 2— Services
1) IntroCam™ provides the technical infrastructure to:
- Record short videos (testimonials) via a browser-based camera interface
- Guide recording persons through structured questions using a teleprompter
- Provide real-time feedback on framing and audio levels via a live feedback panel
- Automatically deliver recorded videos to the customer account upon saving
- Transmit metadata (name, city, country, profession/company) of the recording person
(2) Recorded videos are stored temporarily on the Service Provider’s servers solely for the purpose of delivery to the customer account. After successful delivery, videos are automatically deleted. No permanent storage takes place on the Service Provider’s side.
(3) Video quality is technically limited by the camera hardware, browser, and internet connection of the recording person. The Service Provider does not guarantee any specific level of video or audio quality.
Section 3 — Packages & Pricing
(1) IntroCam™ is is a project tool. It is offered in the following 3 packages. Customers can demand as many times as they want, also for Pro Free Use. The costs are listed under chapter pricing. Only additional offers on long term, such as hosting feedback pages, are to be payed on a monthly basis.
(2) Payment is due immediately upon completion of the order process. All packages are one-time purchases with no automatic renewal.
(3) The validity period begins on the date of payment. Unused video recordings expire at the end of the validity period without entitlement to a refund.
(4) The Service Provider reserves the right to change prices for future orders. Packages already purchased are not affected by price changes.
Section 4— Adress Swap
(1) If a recording person does not respond to the invitation email within 72 hours, the customer receives an automatic notification.
(2) The customer may replace the non-responding email address with a new one (address swap). The number of permitted swaps depends on the package booked.
(3) No refund is due if the customer has exhausted all available swaps or if the validity period has expired.
Section 5— Responsibility for Content – Disclaimer
1) IntroCam™ is a technical communication solution. The Service Provider is not responsible or liable for the content of recorded testimonial videos.
(2) The customer is solely responsible for ensuring that persons invited to record do not produce content that violates applicable law, third-party rights, or public decency. This includes in particular:
- Defamatory, insulting, or otherwise unlawful statements
- Content protected by copyright or trademark law without appropriate authorisation
- Misleading or unfair commercial statements
- Content that violates child protection regulations
(3) The customer shall indemnify the Service Provider against all third-party claims arising in connection with the content of recorded videos and names oder functions.
Section 6 — Right of Inspection upon justified Suspicion
(1) IntroCam™ transports audiovisual communication. The Service Provider does not routinely review the content of recorded videos.
(2) In the event of justified suspicion of a violation of these Terms & Conditions, applicable law, or third-party rights, the Service Provider is entitled to inspect the relevant communication. Justified suspicion exists in particular when: Third parties report potentially unlawful content, Official requests or court orders are received,Patterns of use suggest misuse of the service.
(3) In such cases, the Service Provider is entitled to temporarily withhold delivery of the affected video, notify the customer, and if necessary inform law enforcement authorities.
Section 7 — Data protection & Data Retention
(1) The Service Provider processes personal data of customers and recording persons in accordance with applicable data protection law, in particular the GDPR.
(2) Recorded videos are stored temporarily on the Service Provider’s servers solely for delivery purposes. After successful delivery to the customer account, videos are automatically deleted. No permanent retention occurs.
(3) Recording persons are informed about the processing of their data prior to recording and provide their consent within the meaning of Art. 6(1)(a) GDPR by saving their video.
(4) The customer is responsible for ensuring that invited persons have been informed about the use of their recording and have given their consent.
(5) Further information on data processing is available in the Privacy Policy at www.intro.cam /privacy.
Section 8— Withdrawal & Cancellation
(1) As IntroCam™ is a digital service that is executed immediately upon use, the statutory right of withdrawal lapses upon commencement of the service, provided the customer has expressly agreed prior to concluding the contract that performance may begin before the expiry of the withdrawal period.
(2) In the event of technical failures demonstrably attributable to the Service Provider that prevent proper service delivery, the customer is entitled to a free repeat or a proportional refund.
Section 9— Limitation of Liability
(1) The Service Provider is liable without limitation for damages caused intentionally or through gross negligence by the Service Provider, its legal representatives, or agents.
(2) In all other cases, the Service Provider is liable only for breach of a material contractual obligation whose fulfilment is essential to the proper performance of the contract and on which the customer may regularly rely.
(3) The Service Provider is not liable for video quality deficiencies attributable to the camera hardware, browser, or internet connection of the recording person.
(4) The above limitations do not apply to damages arising from injury to life, body, or health, from the assumption of a guarantee, or under product liability law.
Section 10— Amendments to these Terms
(1) The Service Provider reserves the right to amend these Terms & Conditions at any time, including within existing contractual relationships, provided there are valid reasons and customers are not unreasonably disadvantaged.
(2) Customers will be notified of amendments by email at least two months before they take effect. Consent is deemed granted unless the customer objects before the effective date.
Section 11— Termination
(1) As IntroCam™ operates on a one-time purchase basis without subscription, no separate cancellation is required. The contractual relationship ends automatically upon expiry of the validity period of the booked package.
(2) Both parties retain the right to extraordinary termination for cause.
(3) The Service Provider is entitled to immediately block a customer’s access in the event of a breach of these Terms & Conditions or applicable law.
Section 12— Governing Law & Jurisdiction
(1) These Terms & Conditions are governed by German Law, excluding the UN Convention on Contractrs for the international Sale of Goods (CISG).
(2) The exclusive place of jurisdistion is Frankfurt am Main.
Section 13— Severability
Should any provision of these Terms & Conditions be or become invalid or unenforceable, this does not affect the validity of the remaining provisions. It then applies the closest provision to the economic purpose of the invalid provision.
